This letter to The Magistrates Association explains all. It has been sent now because a group of us will be protesting at the Association in a few days.

Dear Melodie Hyams,
What will magistrates say at their trial or at a Truth and Reconciliation Commission?
I attend a number of plea hearings and trials of Extinction Rebellion and other climate activists and report on my findings. Over the last 3 years of listening to proceedings it is clear that some magistrates and judges have sympathy for the cause of those protesting about climate breakdown and others are vehemently opposed to the protests. What I have seen reveals that some members of the judiciary genuinely believe they are attempting to uphold the rule of law, but there are some magistrates and judges who enter the courtroom without an understanding of the full implications of such cases.
Climate activists aren’t merely protesting about a cause close to their hearts, they are protesting because a corrupt criminal justice system has refused to protect them, their families and others from the greatest act of genocide in history.
Many climate activists who have appeared in court have made the point that they are not the criminals and that the real criminals, who belong on trial, are the politicians and business figures who sustain or expand polluting industries that kill. What concerns me is that, despite so many magistrates hearing such statements, I cannot find a single instance of a member of the judiciary speaking out on the need to prosecute those who are guilty of killing by causing climate breakdown.
What is desperately concerning is that some members of the judiciary have gone beyond being merely complicit in genocide, sometimes the judiciary is actually facilitating and encouraging genocide by justifying the behaviours of those who kill others by causing climate breakdown.
Mass killing on an unprecedented scale
I am sure you are a well informed person, so you should know in broad terms that: -
• The Environment Agency (EA) warns that the infrastructure that supports civilisation is in danger of collapse;
• The EA warns we must “adapt or die”;
• The UK’s official climate advisers, the Committee on Climate Change, warn of disruption to our food supplies in the 2040s and a dramatic reduction in arable farming output further into the future;
• The Royal Institute of International Affairs (Chatham House) has warned that parts of the world will soon become uninhabitable, with unprecedented crop failure and food insecurity driving mass migration;
• The Potsdam Institute for Climate Impacts Research warns that half the world’s population could be killed with 4C of global heating;
• UNICEF warns that over 1 billion children already suffer from some form of exposure to extreme climate risk, with 600 million children now being exposed to increased risk of vector borne disease; and
• Over 1,000 children are already being killed every day by the increased spread of disease in our 1.2C hotter world.
From what I have witnessed, many magistrates don’t understand the science that shows we live in a genocidal society that is murdering hundreds of thousands of people every year and is on track to murder billions. Few magistrates seem to realise that what we do now determines how many people will be killed over the coming decades.
So my first request is that you ensure all magistrates are informed of the above facts, to ensure all understand that the greatest crimes against humanity have now begun. Magistrates need to understand that entire nations will be annihilated (genocide), hundreds of millions of people will be killed and the final death toll may reach the billions.
A corrupt criminal justice system
All members of the Magistrates Association should be informed that in 2019 this group made an attempt to prosecute key UK political figures for crimes against humanity and genocide associated with the policies that kill by causing climate breakdown. A detailed case was submitted to SO15, War Crimes Team at the Metropolitan Police, but the police refused to mount a criminal investigation, claiming that there had to be ‘intent’ for a prosecution to succeed. However, when we explained English law concerning the concepts of ‘direct intent’ and ‘oblique intent’ and explained that Article 30. 2(b) of the Rome Statute specifically addressed crimes of ‘oblique intent’ ; the police categorically refused to address or analyse the legal points made.
After lengthy appeal processes, the case was referred to the International Criminal Court (ICC) (Reference OTP: CR: 22/21). The ICC Prosecutor’s Office posed three questions to establish jurisdiction and is now giving detailed consideration to the case. The ICC does not accept the thinking of the Metropolitan Police.
Quite separately, on 12 October 2021, another case was submitted to the ICC. This is in connection with crimes against humanity associated with climate breakdown committed by the President of Brazil. It is to be expected that as more national criminal justice systems fail to protect their citizens from killers, other cases will be lodged with the ICC.
What is of crucial importance to the magistrates you represent is that the English criminal justice system has failed in the most important area of criminal law – crimes against humanity and genocide. The police have refused to investigate those who kill, despite making it clear that they do not dispute that hundreds of thousands of people are being killed every year.
A number of public figures have recently had cause to accuse The Met of institutional corruption (protecting the most powerful political and business figures in the country). We too have accused The Met of institutional corruption for refusing to use the International Criminal Court Act 2001 and Rome Statutes to stop the killers. The evidence we have accumulated is damning.
In light of the fact that the English criminal justice system has refused to protect the people from those who would kill, Extinction Rebellion and other groups have begun to protest in dynamic terms trying to stop the murderers. Some members of Extinction Rebellion have even undertaken ‘Disobey in the Dock’ actions that have impacted your magistrates.
Had the criminal justice system acted to stop the killers, there would be no need for anyone to protest on the streets or ‘Disobey in the Dock’. Despite the fact that protesters are trying to stop killers from killing or grievously injuring the young, the English Courts remain determined to put on trial, convict and sentence our finest, most courageous citizens – the environmental protesters.
Sadly this situation will escalate because the police lobbied government for tougher penalties to curtail the ability of the British people to protest dynamically against the killings. As a consequence of The Met’s institutional corruption, magistrates will soon be asked to impose tougher sentence on citizens trying to stop genocide.
Steps now required of all Magistrates and Judges.
All members of the judiciary have a direct personal interest in cases brought against climate activists. Magistrates either care about the youngest members of their own families being killed by climate breakdown or they care more about their right to fly, eat red meat, drive cars and overheat homes. No member of the judiciary is impartial in this; everyone in the country has a direct personal interest in this.
Given that the criminal justice system has refused to use existing legislation (ICC Act 2001) to stop the murder of British citizens and given that our politicians are responsible for killing hundreds of thousands of children abroad every year, I ask that magistrates initiate a moratorium on plea hearings and trials of environmental campaigners who have undertaken peaceful action to stop murder. The moratorium should remain in place until the decision by the International Criminal Court has been made on the two cases now before it.
There can be no excuse for continuing with hearings that impose real suffering and hardship upon those who are trying to stop the murderers. All such hearings must be postponed until the ICC has been given an opportunity to act where The Met has refused to act - and stop the killers.
Will Magistrates be summoned to Truth & Reconciliation Commission hearings or committed for trial?
When magistrates and judges sentenced black slaves to mutilation or death, or upheld the cruelty of apartheid, or sent gay men to prison, ordering chemical castration, or inflicted other horrors, it can be argued that the judiciary was made up of people who knew no better. Many will argue they were merely a product of the cruelty of the era in which they lived.
But attitudes to climate breakdown are very different, because everyone knows of the suffering that is now being inflicted upon the most vulnerable nations of the world. Most people don’t yet understand the detail set out above, but all magistrates will have some degree of understanding of the horrors to be deliberately inflicted upon the youngest member of every family in the UK.
In light of recent comments made at international conferences by youth representatives, including the MockCOP26 conference, at which a Treaty was adopted that called for a scale of penalties that match the staggering harm caused, it is entirely foreseeable that trials of the worst climate criminals are coming. Extreme suffering is unfolding and the young will seek retribution. It may be that retribution will end with the trials of political and business leaders but, given the refusal of the criminal justice system to use existing legislation to prevent the killing of so many young people, magistrates must prepare themselves for some form of ‘Truth & Reconciliation Commission’ hearing or trial for crimes against humanity.
A crucial difference between the Truth & Reconciliation Commission in South Africa and the stance adopted to the climate criminals, who either caused or were complicit in climate breakdown, is that the killings not only continue, they accelerate. From around 2030 onwards the scale of the suffering that will unfold this century will be clear for all to see and, from 2040 onwards, that extreme suffering and mass loss of life will dominate all human activities in every country on the planet.
Everyone in public life, as the judiciary are, must find a way to make it crystal clear that they have taken dynamic steps to stop climate genocide. It may be that magistrates will refuse to hear cases involving peaceful environmental protesters; at least until the police and prosecuting authorities have agreed to use the ICC Act 2001 and Rome Statute to stop political and business leaders from killing. But, if not, magistrates need to find some other way to show they are working to stop the institutional corruption within The Met that has so far prevented a criminal investigation.
Every magistrate needs to be clear about their personal intentions and how they could justify themselves if called to account in a court of law. Magistrates need to ask themselves if they said or did anything that indicated support for genocide or crimes against humanity. In the 2040s, as the UK food supply suffers extreme disruption, millions of people suffer appalling damage to their homes and billions of climate refugees are fleeing famine, how will magistrates be judged?
Action required.
When a matter this serious, with huge implications for your members comes to your attention, I put it to you that you have a duty to bring it to their attention. I therefore urge you to circulate this letter to all magistrates and ask them to consider the appropriate response to the refusal of the criminal justice system to protect the British people from those who would kill them.``
